Contest Rules – 20K Idea

1. HOW TO ENTER

No purchase necessary. Are you a young person who has an idea to help your community and make a difference? Enter a video for a chance to win a $20,000 charity donation. Entrants must be between the ages of 13 and 17 and must obtain parental consent before entering the contest.

Register for an account and enter the contest at www.telusforweday.com (the “Entry”). Entrants will be required to provide their parent’s/or legal guardian’s contact information on their Entry.

All video entries must be approximately 1 minute and 30 seconds in length or less. An entrant cannot upload a video via the website. All video submissions must be uploaded online by the entrant. Entrants must copy the URL link of their video and paste it in the entry form. Your Entry must contain the theme “What would you do within your community to help make a difference?”. By entering the contest you are consenting to the display of your Entry publicly on the telusforweday.com website and/or other TELUS and Free The Children online properties.

You must obtain written permission, using the personal release and consent form attached, from any person, other than yourself, who appears in your Entry. If a person in your video is under the age of 18 years of age parental consent will be required.

Entrants will be permitted to make multiple submissions (up to a maximum of 10 entries) to the telusforweday.com website. The parent or legal guardian will be contacted if their child is selected as a winner. TELUS does not accept entries for this contest by phone, fax, courier, mail or email. This contest is intended for residents of Canada only and will be interpreted according to Canadian law. Contest runs from September 28, 2012, at approximately 12:00 a.m. EST to November 12, 2012, at approximately 11:00 p.m. EST (the “Contest Period”).

2. ENTRIES

An Entry will be considered void if:

  • it does not contain the theme “What would you do within your community to help make a difference”:
  • the entrant is not between the ages of 13 and 17 years of age;
  • it, in the opinion of the contest administrators, contains content that infringes any right of any third party (for example, music or picture copyright);
  • it contains subject matter that, in the opinion of the contest administrators, may violate community standards or is otherwise of questionable taste; or
  • it is otherwise unlawful.

You agree that you won’t be paid for your Entry or receive any form of compensation from TELUS for your Entry. You acknowledge and agree that you will not to post your Entry or other media in connection with your Entry in or on any public forum (including, but not limited to, the Internet) or elsewhere or show or otherwise distribute your Entry or other media in connection with your Entry to any audience or to any party other than TELUS for the purposes of this contest, and that TELUS shall have the right to display your Entry whenever and wherever required for TELUS’s purposes.

You warrant and represent that you own all rights to your Entry. By submitting an Entry, you irrevocably grant TELUS and its affiliates, legal representatives, assigns, agents and licensees the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used) your Entry, as well as to use your name, likeness, photograph (“Likeness”) and/or statements regarding your participation in this contest (with or without using your name) in any and all media without limitation as to time or territory and without additional compensation or approval from you or any other party. You hereby waive all intellectual property rights, privacy/publicity rights and other legal and moral rights that might preclude TELUS or its affiliate’s use of your Entry, and you agree not to sue or assert any claim against TELUS for the use of your Entry or your Likeness or statements.

You agree to indemnify and hold TELUS, its affiliates and agencies and their respective affiliates, officers, directors, agents and any of their employees (collectively, the “Indemnitees”) harmless from any and all claims, damages, expenses, costs (including reasonable lawyers' fees) and liabilities (including settlements) brought or asserted by any third party against any of the Indemnitees due to or arising out of your Entry or your conduct in creating an Entry or otherwise in connection with this contest, including, but not limited to, claims for trademark and copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation. You further agree to release TELUS and its affiliates from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of TELUS infringes your rights with regard to any elements, characters or ideas contained in any Entry.

3. THE PRIZE

There will be one (1) prize awarded which will consist of a $20,000 donation made by TELUS to a registered Canadian charitable organization (must be registered with Canada Revenue Agency) on behalf of the winner. The TELUS Community Investment team will assist the winner with partnering with the appropriate charity and help facilitate the project initiation and development. The winner will have up to one year from the date of the prize being awarded to choose a charity. If the winner does not select a charity within the specified time period TELUS will select the charity on behalf of the winner.

4. ELIGIBILITY

To be eligible, entrants must submit an Entry during the Contest Period. This contest is open to all residents of Canada who are between the ages of 13 and 17. This contest excludes employees of TELUS Corporation and Free The Children, their affiliated companies or subsidiaries, their advertising and promotional agencies and members of their respective immediate families, and any person domiciled with any of the above.

4. WINNER SELECTION

There will be two phases to determine the winner. In phase 1, the top 25 Entries will be selected. In phase II, the winner will be selected from the top 25 Entries. In both phases the selection process will be based on the following judging criteria:

  • Innovation 25%: Does the idea utilize technology and/or creative problem solving to make a difference in their community;
  • Sustainability 25%: Does the idea generate ongoing/long-term benefits for the community;
  • Feasibility 25%: How realistic is the idea. Does it fit with a charities needs; and
  • Local impact 25%: Will the idea benefit the local community and it’s members? In the event of a tie for the 25th spot, a random draw will be conducted amongst the tied Entries. The judging panel for phase 1 will be comprised of representatives from Free The Children and TELUS. The judging panel for phase 2 of this contest will be made up of three judges in total. Two representatives from Free The Children and one representative from TELUS.
6. THE WINNERS

The potential winning entrant will be selected by December 4, 2012, by approximately 5:00 p.m. EST. The selected entrant’s parent or legal guardian will be notified by telephone within two business day of the draw. If the selected entrant’s parent or legal guardian cannot be reached within two business day, another entrant will be selected from the remaining eligible entries.

The parent or legal guardian of the winner will be required to sign a standard release form confirming compliance with the Contest Rules and releasing TELUS and its directors, officers, partnership interest holders, representatives, advertising and promotional agencies from any and all liability arising out of, pursuant to or as a result of the carrying out of the contest, including liability arising from the acceptance of and usage of the prizes as awarded. Failure to comply with the Contest Rules or to sign and return the release form within five (5) days of receipt will result in disqualification and another Entry will be drawn.

7. ENTRIES

All entries become the property of TELUS. TELUS assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website, for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any email or entry to be received by TELUS on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from this contest. TELUS reserves the right, at its sole discretion, to change, cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of TELUS and its advertising and promotional agencies corrupt the security or proper administration of the contest or for any other reason. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with, or unlawful in any way. Entries submitted by unauthorized means or by spamming will be disqualified. In the event that it has been determined that an entry has been made in a manner not sanctioned by these rules and/or an entrant has submitted more than the number of entries permitted by these rules, the entrant and all of their entries will be disqualified. Entrants agree to abide by the Contest Rules and the decisions of the contest judges, which are final. This contest is subject to all applicable laws and regulations.

8. PRIVACY

By entering the contest, an entrant consents to the use of their name, city of residence, photograph, voice and/or image for publicity purposes in all media used by TELUS without payment or compensation. Entrants agree to TELUS using the entrant’s personal information as described in the TELUS Privacy Commitment located at telusforweday.com.
